Terms and Conditions

What we provide Monumental Cakes provide individually crafted wedding, birthday and celebration cakes using the finest, freshest ingredients. Included in the quoted price will be the cake, coverings, decorations, internal support structure, boards, ribbons and boxes.  Delivery & set-up within 10 miles of the Monumental base in Pembury is free, anything further and a delivery charge will be applicable.

Orders
For celebration orders please allow at least 10-14 days’ notice, shorter timescales and last-minute orders will be accommodated where possible but choices of design may become limited the less notice is given. 

Please allow a minimum of 12 weeks for any wedding cake, shorter timescales will be accommodated where possible but choices of design may become limited.  

Orders are only confirmed on receipt of a deposit.  Failure to pay a deposit within the specified timeframe may result in a provisional order being cancelled (methods of payment are detailed below). 

Monumental Cakes will not be held liable in the event that the customer misses any of our emails (being for cake orders, deposits, and delivery/collection arrangements), due to internet, software or full mailbox or computer problems.

Order alterations that are made with less than 7 working days to the due date will be accommodated where reasonably possible and will incur an additional charge. No alterations can be made within 5 working days to the delivery date.

Portion and cutting guides are available on the Monumental Cakes website.  Portion guides are only approximate and dependent on correct cutting.  We cannot be held responsible for shortfalls in portions.

In very rare and exceptional circumstances we reserve the right to cancel an order at any time.  No charges will be made and you will receive a full refund of your deposit, however, no compensation will be payable should this occur.

Payment
A minimum non-refundable deposit for celebration cake orders of 20%, and 50% for wedding cakes is due at the point of order.  All orders are provisional until a deposit is received and payment has cleared.  Failure to pay a deposit within the specified timeframe may result in your provisional order being cancelled.

The balance of the order is due not less than 3 days prior to collection/delivery for all celebration cakes and only where agreed payment may be made upon collection/delivery.  Payment is due not less than 7 days prior to collection/delivery for all wedding cakes.  Payment delays may result in delivery deadlines being extended. If you decide to cancel your order within the 7 days prior to delivery/collection, you will still be liable for the final payment and there will be no refunds.  In certain circumstances we may be able to store/freeze your cake for up to 3 months.  This may be agreed on an individual basis and at the discretion of Monumental Cakes and may incur further costs.

Delivery and Collection In order to ensure that your cake is delivered and set-up in the best possible condition, Monumental Cakes highly recommend that they personally deliver.  Delivery is free within 10 miles of the TN2 postcode.  Anything further will be charged @45p per mile. 

In the (unlikely) event that the Monumental Cakes delivery vehicle becomes involved in an accident, and the customer’s cake is irreparably damaged, we will provide the customer with a full refund that will include the cost of the cake and delivery fee. Monumental Cakes will not be liable for any further charges.

Venue parking should be available for delivery. If unavailable, any parking fees will be charged to the customer.

Once the cake has been set-up, we will take photographs for our records which may also be used for marketing purposes on our website or publicity materials.  We cannot be held responsible for any damage or loss occurring to the cake after we have left the venue.

Cakes that are collected from Monumental Cakes are always boxed for transportation. We provide full instruction on the care and handling of your cake. We would always recommend picking up your cake in a vehicle, tiered cakes can be very heavy. We do not take any responsibility for any damage that may occur to the cake once it has left our premises.

Please note: Once the cake has been collected / delivered, the risk of damage passes to the client.

Tiered cakes are most at risk during transport and every care should be taken by the customer to ensure their cake is as safe and secure as possible during transit.  Specific guidelines will be provided.

Data Privacy Any Client contact information will be used for the purposes of Monumental Cakes only and not passed onto third parties.  Clients will only be contacted in relation to orders made and also in the event that they have opted to receive regular updates on news and classes.

Intellectual Property Monumental Cakes is a Registered Trademark with the IPO.  Journal Entry 2019/029.  Photographs taken of a Client’s order completed by Monumental Cakes remain the property of Monumental Cakes and may be used for marketing purposes on our website or publicity materials.  Any orders placed remain the property of Monumental Cakes until full payment has been received and the Client has taken delivery of the order.

Allergies Monumental Cakes is able to cater for special dietary requirements such as vegan, egg-free, gluten-free or dairy free. However, please be aware that some of the ingredients used to fulfil a Client’s order may contain nuts – so Monumental Cakes is unable to cater for a nut allergy requirement.  Full ingredient listings are provided with each order and it is the Client’s responsibility to ensure that anyone who is consuming the cake is made aware of any allergens present.

Force Majeure Monumental Cakes will not be liable or responsible for any failure to perform or delay in performance of, any of our obligations under these terms and conditions that is caused by events outside our reasonable control (“Force Majeure Event”).

A Force Majeure Event includes any act, event, non-occurrence, omission or accident beyond our reasonable control and you agree that the following shall all be Force Majeure Events:

1. Extreme weather conditions preventing your event taking place, your order being delayed for any reason including but not limited to winds, snow, rain, storm, fire or floods or any natural disaster whatever;

2. Impossibility or difficulties with the use of any relevant means of public or private transport for any reason;

3. Cancellation by any third party of related services;

4. Inability to receive materials ordered due to a third-party supplier failure which was beyond our control;

5. Civil unrest, riots, strikes, transport delays and anything connected with such events.

Our obligations under the General Terms and Conditions are suspended for the period that the Force Majeure Event continues, and we will have an extension of time to perform these obligations for the duration of that period.

In all cases, we will take reasonable steps to bring the Force Majeure Event to a close or to find a reasonable solution by which our obligations under these General Terms and Conditions can be performed despite the Force Majeure Event.  If this is not possible, we will discuss with you how best to address this.

Complaints We have every confidence in our product, however, in the unlikely event that you are not happy with the quality of the order received from Monumental Cakes please notify us immediately of the issue and return the order to us.  Monumental Cakes are not liable for complaints where the Client has failed to follow the transportation, storage and cutting guidelines provided.  We will not provide refunds where the order has been fully consumed unless the Client can show liability.

Governing Law & Jurisdiction These Terms and Conditions will be governed by English law and the parties submit to the exclusive jurisdiction of the English courts in relation to any dispute which may arise between them.
